DMCA Policy

SECTION 1: OVERVIEW

Rosewood Software Systems Inc. respects the intellectual property rights of others and expects users of its Services to do the same. This policy describes how Rosewood handles claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and applicable Canadian copyright law under the Copyright Act (Canada).

SECTION 2: REPORTING COPYRIGHT INFRINGEMENT

If you believe that content available through the Rosewood platform or website infringes your copyright, you may submit a written notice to our designated DMCA agent at the contact information below.

To be valid, your written notice must include all of the following:

  1. Your full legal name and contact information including mailing address, telephone number, and email address.
  2. A description of the copyrighted work you claim has been infringed.
  3. A description of where the allegedly infringing material is located on our platform or website, with enough detail for us to locate it.
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law.
  5. A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Your physical or electronic signature.

SECTION 4: COUNTER-NOTIFICATION

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include:

  1. Your full legal name, mailing address, telephone number, and email address.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the courts in your jurisdiction and that you will accept service of process from the person who submitted the original infringement notice.
  5. Your physical or electronic signature.

SECTION 5: REPEAT INFRINGERS

Rosewood has a policy of terminating accounts of users who are found to be repeat infringers of intellectual property rights in appropriate circumstances.

SECTION 6: ROSEWOOD INTELLECTUAL PROPERTY

All content, templates, workflows, software, designs, trademarks, and documentation created by Rosewood Software Systems Inc. are protected by copyright and other intellectual property laws. Unauthorized reproduction, distribution, or use of Rosewood intellectual property is strictly prohibited and may result in legal action.

SECTION 7: DISCLAIMER

Submission of a DMCA notice does not create an attorney-client relationship between you and Rosewood. Rosewood recommends consulting a licensed attorney if you have questions about your intellectual property rights.
