This Privacy Policy explains how Rosewood Software Systems Inc. collects, uses, discloses, and protects personal information in connection with its website and compliance software products. Rosewood is committed to protecting your privacy in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

SECTION 1: OVERVIEW AND WHO WE ARE

Rosewood Software Systems Inc. ("Rosewood," "we," "us," or "our") is a federally incorporated corporation under the Canada Business Corporations Act, Corporation Number 1776009-4, with its registered office at 375 University Avenue, Suite 3228, Toronto, Ontario, M5G 2J5, Canada.

This Privacy Policy applies to personal information collected from operators, subscribers, and website visitors. It also addresses how Rosewood handles tenant and third-party personal information entered into the Services by operators.

SECTION 2: PERSONAL INFORMATION WE COLLECT

Rosewood collects personal information in the following categories:

2.1 Account and Operator Information

When you create an account or subscribe, we collect: full name, email address, business name and park or property name, business address, phone number, account login credentials, subscription plan and billing history.

2.2 Payment Information

Payment processing is handled by Stripe Inc. Rosewood does not store full payment card numbers, CVV codes, or bank account details. Stripe's privacy policy governs their handling of payment information.

2.3 Tenant and Third-Party Information Entered by Operators

When operators use ParkNotice or other Services, they may enter personal information about tenants and third parties, including: tenant full names, lot numbers and service addresses, lease information and tenancy details, notice history and compliance workflow records, delivery addresses for certified mail, lienholder information where applicable, and military status information where legally required.

This information is used solely to generate and deliver the compliance documents and services requested by the operator. Operators are responsible for ensuring they have lawful authority to submit this information.

2.4 Mailing and Delivery Data

When operators use the certified mail feature, physical mailing addresses are transmitted to Lob Inc. for printing and dispatching certified mail. Delivery tracking information and proof of delivery records are stored in the Services on behalf of the operator.

2.5 Platform Usage and Technical Data

When you use the Services, we automatically collect: log data including IP address, browser type, and access times, workflow activity and document generation history, compliance action timestamps and audit trail records, and device and operating system information.

2.6 Communications Data

When you contact us, we retain records of that correspondence including your name, email address, and the content of your communications for support and quality assurance purposes.

SECTION 3: HOW WE USE PERSONAL INFORMATION

Rosewood uses personal information only for the purposes for which it was collected. We use personal information to:

  • Create and manage your account and subscription
  • Provide, operate, and improve the Services
  • Generate compliance documents on behalf of operators
  • Process certified mail through our mailing provider
  • Process payments through Stripe
  • Communicate with you about your account, billing, and the Services
  • Provide customer support and respond to inquiries
  • Maintain compliance audit trails and proof of service records
  • Monitor and improve platform security and performance
  • Meet our legal and regulatory obligations
  • Archive records for potential future legal proceedings

We do not use personal information for advertising, marketing profiling, or any purpose unrelated to the provision of the Services without your explicit consent.

SECTION 4: LEGAL BASIS FOR PROCESSING

Under PIPEDA, Rosewood collects, uses, and discloses personal information with the knowledge and consent of the individual, or as otherwise permitted by law. Our legal bases are:

  • Contractual necessity: Processing required to perform the Services you have contracted for.
  • Legitimate interests: Processing for platform security, fraud prevention, and maintaining compliance audit records.
  • Legal obligation: Processing required to comply with applicable Canadian law.
  • Consent: Where we rely on consent, you may withdraw it at any time.

SECTION 5: DISCLOSURE TO THIRD PARTIES

Rosewood does not sell, rent, or trade personal information to third parties. We share personal information only with the following service providers:

Stripe Inc.

Purpose: Payment processing and billing

Data shared: Name, billing address, payment method

Location: United States

Lob Inc.

Purpose: Certified mail printing and delivery

Data shared: Recipient name and mailing address

Location: United States

Airtable Inc.

Purpose: Database and compliance tracking

Data shared: Operator and tenant workflow data

Location: United States

Softr Inc.

Purpose: User interface for compliance tracking platform

Data shared: Operator account credentials and tenant workflow data displayed through the platform interface

Location: United States

Note: Some service providers are located in the United States. Rosewood requires all service providers to protect personal information to a standard consistent with PIPEDA.

5.2 Legal Requirements

Rosewood may disclose personal information where required by law, court order, subpoena, or lawful government request, or where necessary to establish or defend legal claims.

5.3 Business Transfers

In the event of a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction with advance notice provided.

SECTION 6: DATA RETENTION

Rosewood retains personal information only as long as necessary:

  • Operator account data: Retained for the duration of the active subscription and for 7 years following cancellation, to support legal and compliance obligations.
  • Tenant and third-party personal information: Retained for 7 years following account cancellation to support operator compliance records and potential legal proceedings.
  • Payment records: Retained for 7 years as required by Canadian tax and business records legislation.
  • Platform usage and technical data: Retained for up to 2 years for security and performance purposes.

Following the applicable retention period, personal information is securely deleted or anonymized.

SECTION 7: DATA SECURITY

Rosewood implements reasonable technical and organizational security measures including:

  • 256-bit encryption for data in transit and at rest
  • Access controls limiting personal information access to authorized personnel only
  • Secure server infrastructure
  • Regular security monitoring and logging

No system is completely secure. Please notify us immediately at support@rosewoodsystems.io if you suspect unauthorized access to your account.

SECTION 8: YOUR PRIVACY RIGHTS UNDER PIPEDA

8.1 Right to Access

You have the right to request access to the personal information Rosewood holds about you. Contact us at compliance@rosewoodsystems.io. We will respond within 30 days.

8.2 Right to Correction

If personal information we hold about you is inaccurate or incomplete, you have the right to request correction.

8.3 Right to Withdraw Consent

Where processing is based on consent, you may withdraw consent at any time by contacting compliance@rosewoodsystems.io. Withdrawal may affect your ability to use some or all of the Services.

8.4 Right to Complain

If you believe Rosewood has not handled your personal information in accordance with PIPEDA, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada at www.priv.gc.ca.

8.5 Tenant Data Requests

If you are a tenant whose personal information has been entered by a park operator, your primary point of contact is the operator. For unresolved privacy concerns, contact us at compliance@rosewoodsystems.io.

SECTION 9: CROSS-BORDER DATA TRANSFERS

Rosewood's service providers including Stripe, Lob, and Airtable are located in the United States. Personal information transferred to these providers is subject to U.S. law, which differs from Canadian privacy law.

Rosewood requires all service providers to protect personal information through contractual obligations consistent with PIPEDA. By using the Services, you acknowledge and consent to these cross-border transfers.

SECTION 10: COOKIE POLICY

Rosewood's website and Services do not use cookies, tracking pixels, advertising tags, analytics scripts, or any other tracking technologies that collect personal information about your browsing behavior.

Rosewood does not use:

  • Google Analytics or any analytics platform
  • Facebook Pixel, Google Ads tags, or advertising retargeting tools
  • Session recording or heatmap tools
  • Third-party tracking or profiling cookies

The only technical data collected when you visit the Rosewood website is standard server log data including IP address, browser type, and access timestamps. This is collected for security and operational purposes only and is not used to track or profile individual visitors.

Because Rosewood does not use non-essential cookies or tracking technologies, no cookie consent banner is required on this website at this time. If Rosewood introduces any analytics or tracking tools in the future, this policy will be updated and a consent mechanism will be implemented before any such tools are activated.

SECTION 11: ELECTRONIC COMMUNICATIONS AND CASL

Rosewood complies with Canada's Anti-Spam Legislation (CASL). We only send commercial electronic messages to individuals who have provided express or implied consent in accordance with CASL requirements.

Where we send commercial electronic messages, every message will include:

  • Clear identification of Rosewood Software Systems Inc. as the sender
  • Our mailing address at 375 University Avenue, Suite 3228, Toronto, Ontario, M5G 2J5
  • A functional unsubscribe mechanism

Rosewood will process all unsubscribe requests within 10 business days of receipt.

SECTION 12: CHILDREN'S PRIVACY

The Services are intended for business operators and are not directed at individuals under the age of 18. Rosewood does not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a person under 18, please contact us at compliance@rosewoodsystems.io and we will promptly delete that information.

SECTION 13: CHANGES TO THIS POLICY

Rosewood may update this Privacy Policy from time to time. Material changes will be communicated to active subscribers via email or in-platform notification at least 30 days before taking effect.

The current version of this policy will always be available on our website. Continued use of the Services after the effective date of any update constitutes acceptance of the revised policy.
